New Zealand Firearm Sales Terms & Conditions
Dealer Licensed Business — Compliant with Arms Act 1983 & FSA Rules
These Terms and Conditions govern all firearm, ammunition, airgun, firearm parts and accessory sales transactions made by the Licensed Firearm Dealer (“the Seller”) and the purchasing customer (“the Buyer”). All sales are subject to the New Zealand Arms Act 1983, Arms Regulations 1992, and all current Firearms Safety Authority (FSA) operational requirements.
By browsing the website, submitting an enquiry or completing any purchase, the Buyer confirms that they have read, understood, and unconditionally accepted all terms below.
1. Legal Eligibility & Licence Verification (Mandatory)
1.1 The Seller strictly complies with all legal obligations to verify the Buyer’s lawful entitlement to possess firearms or ammunition under New Zealand law.
1.2 For all firearms, restricted parts and ammunition purchases:
- The Buyer must hold a valid, in-date New Zealand Firearms Licence with correct and current endorsements matching the item category (A/B/C/P etc.).
- The Buyer must present the original physical licence for in-person verification, and provide all information required for official record-keeping.
1.3 The Seller reserves the right to refuse any sale without further explanation if:
- The Buyer’s licence is expired, suspended, restricted, invalid or suspected to be counterfeit;
- The Buyer does not hold the required endorsement for restricted firearms, magazines or parts;
- There is any legal reason or police / FSA advisory preventing the sale.
1.4 For standard airgun purchases (non-dangerous airguns): the Buyer must be 18 years of age or older and provide valid photo ID as required by NZ Police rules.
1.5 The Buyer acknowledges that selling, gifting, transferring or allowing third-party possession of purchased firearms without lawful authority is a serious criminal offence under New Zealand law.
2. Item Classification & Compliance Declaration
2.1 All goods listed on this website are categorised strictly in accordance with current New Zealand firearm classification rules (A-class, restricted, MSSA, prohibited items).
2.2 Website listings are for product information only. Online display does not guarantee availability or legal purchasability for individual buyers. Final classification eligibility will be confirmed in-store after licence inspection.
2.3 MSSA and prohibited items will never be sold to customers without the corresponding lawful endorsement.
3. Pricing, Deposit & Payment
3.1 All displayed prices are in New Zealand Dollars (NZD), GST included unless otherwise noted.
3.2 Online listings do not constitute a legally binding offer. A sales contract is formed only after in-person identity check, licence validation, deposit / full payment completion and dealer paperwork registration.
3.3 When a deposit is placed for reservation:
- Deposits are non-refundable if the buyer cancels due to failing licence checks, personal change of mind or inability to meet legal purchasing requirements.
- If the seller cannot supply the item, the full deposit will be returned.
3.4 Full settlement must be completed before firearm collection. No lay-by arrangement overrides FSA record-keeping obligations.
4. Condition Description & Pre-Sale Inspection
4.1 Used firearms are described to the best of the Seller’s ability. All second-hand units are available for physical inspection on-site.
4.2 The Buyer agrees to inspect the firearm thoroughly at the time of collection. Once the Buyer takes possession, condition complaints based on cosmetic wear will not be accepted. Functional defects covered by manufacturer warranty shall follow the original brand’s warranty policy.
5. Risk Transfer & Collection
5.1 Ownership and risk of loss or damage pass to the Buyer upon successful handover from the dealer premises, after all statutory paperwork has been completed.
5.2 Firearms cannot be dispatched by courier. All firearms must be collected in person at the licensed dealer address by the licensed purchaser.
5.3 Ammunition collection also requires a valid firearms licence.
6. Returns and Refunds
6.1 Because firearms sales are heavily regulated under the Arms Act, the standard consumer cooling-off period under the Consumer Guarantees Act does not apply to firearm transactions.
6.2 A refund will only be approved if the item has an undiscovered critical functional fault, verified by a qualified gunsmith immediately upon collection. Cosmetic issues do not qualify for return.
6.3 No returns for change-of-mind purchases.
7. Website Disclaimer
7.1 Product photos online are for reference only. Actual appearance may differ. The Seller does not guarantee real-time stock accuracy on the website. Please confirm stock status by email or in-store.
7.2 Nothing published on this website counts as legal advice. All buyers must satisfy themselves that they meet legislative requirements before attempting to purchase.
8. Limitation of Liability
8.1 The Seller shall not be liable for any injury, loss or damage arising from improper storage, careless handling, unlawful modification or reckless use after the Buyer has taken possession of goods.
8.2 Maximum Seller liability shall not exceed the original purchase price of the item.
9. Governing Law
These terms shall be governed and interpreted under the laws of New Zealand. Any dispute shall be resolved within New Zealand jurisdiction.
10. Amendment Right
The dealer reserves the right to update these terms at any time. Revised clauses take effect once published on this webpage. Continued use of the site after an update means you accept the new conditions.
